Terms and conditions of sale

1. Seller identity
The website www.resell-lausanne.ch (the “Site”) is operated under the brand “Resell Lausanne” by Solutions Manzinali, sole proprietorship, Chemin de Bas-de-Plan 6, 1030 Bussigny, Switzerland, business ID CHE-309.864.712, VAT no. CHE-309.864.712 (hereinafter “Resell Lausanne”, “we”).
2. Scope
These terms and conditions of sale (“T&Cs”) govern any order placed on the Site by a private or professional customer (the “Customer”).
Any order implies full acceptance of these T&Cs, the return and refund policy, the privacy policy and, where applicable, any special conditions stated on the Site or at checkout.
3. Products
Resell Lausanne sells sneakers, apparel, accessories and, where applicable, authentic collectibles.
Some products may be sourced on demand after order confirmation from partners, platforms, professional resellers or individuals. Actual availability, timing and logistics may depend on that supply chain.
Photos, descriptions, visuals and size charts are indicative. Minor differences in shade, material, marking, packaging or accessories may exist depending on series, distribution country or manufacturer version.
4. Authenticity and inspection
Resell Lausanne applies reasonable measures to inspect, authenticate and verify product condition.
If a product does not meet our internal conformity, authenticity or condition standards, we may refuse shipment and cancel the order. In that case, the Customer is refunded amounts actually collected for the order concerned.
5. Order and contract formation
The Customer must carefully check cart contents, contact details, billing/shipping addresses, selected size, total price and any applicable fees before confirming.
Submitting the order constitutes an offer to purchase by the Customer.
The contract is formed only after:
- receipt of the order;
- validation by Resell Lausanne; and
- electronic order confirmation, or actual product shipment.
We reserve the right to refuse or cancel an order, including in case of:
- unforeseen product unavailability;
- manifest price or description error;
- sourcing failure;
- inspection/authentication failure;
- suspected fraud or abusive use;
- inaccurate or incomplete customer information.
6. Prices
Applicable prices are those shown on the Site at the time of order, subject to manifest error.
For consumer sales in Switzerland, prices include non-optional charges required for the purchase. Shipping fees may be shown separately when they vary by order.
For international orders, import taxes, customs duties, local VAT, handling or administrative fees may be due in the destination country. Unless expressly stated otherwise at payment, these remain the Customer’s responsibility.
7. Payment
The price is payable immediately at order via the payment methods offered on the Site.
The order is processed only after payment authorisation.
In case of payment refusal, unjustified chargeback, suspected fraud or abusive use of a payment method, we may suspend or cancel the order and take any useful measure.
Purchase by invoice with partial payment option (POWERPAY)
As an external payment provider, MF Group/POWERPAY offers the payment option «Pay by invoice». You can simply pay for your online purchase by invoice using the order invoice. If you do not make the payment within the specified period, you will receive a subsequent monthly invoice the following month with an order overview.
When a purchase agreement is made, POWERPAY takes on the amount receivable and processes it using the payment method selected. By selecting purchase by invoice, you are also agreeing to our GTC and POWERPAY's GTC (powerpay.ch/en/agb).
8. Availability and seller cancellation
Products shown on the Site are offered subject to sourcing possibilities.
When a product is sourced on demand, a supply incident, quality/authenticity rejection, availability error or logistics event may make performance impossible.
In that case, we inform the Customer promptly and proceed, as appropriate, with a refund, an equivalent proposal or another suitable solution.
9. Delivery
Deliveries are made to the address indicated by the Customer at checkout.
Displayed timeframes are estimates, unless expressly agreed otherwise in writing.
For on-demand products, delivery may include several steps:
- order validation;
- sourcing or acquisition;
- shipment to Resell Lausanne or a partner;
- inspection, verification or authentication;
- preparation;
- final dispatch.
A reasonable delay does not automatically entitle the Customer to cancellation, indemnity or damages, unless mandatory law provides otherwise. If the delay is significant, the Customer must first grant Resell Lausanne a reasonable additional period in writing before requesting cancellation. See Shipping FAQ.
10. Transfer of risk
Subject to mandatory consumer law, the risk of loss or damage passes to the Customer upon physical delivery to the stated address, or upon handover to the Customer or any third party designated by them.
11. Incorrect address, refused delivery, unclaimed parcel
The Customer alone is responsible for the accuracy of their details.
In case of inaccurate or incomplete address, refused delivery, unclaimed parcel or return to sender attributable to the Customer, return, handling, storage and reshipment fees may remain payable by the Customer.
In particular, reshipment of an unclaimed parcel returned to us may be arranged for a flat fee of CHF 20.– (about CHF 9.– Post return label, about CHF 7.– new outbound label, remainder for search and handling). See FAQ — unclaimed package.
12. Returns, withdrawal and refunds
Return, withdrawal, exchange, store-credit and refund rules are set out in the return and refund policy, which forms an integral part of these T&Cs. Return request: return form.
Voluntary returns apply to sneakers / footwear only. Apparel is excluded except for our error or proven defect. Also excluded (except our error or proven defect): watches, jewellery, collectibles, any non-sneaker product, any item with a purchase price above CHF 650.–, and any item purchased on sale, Soldes 48h, clearance, archive or at a promotional price (compare-at / strikethrough price).
Every return requires prior written approval from Resell Lausanne. No return without approval or to an uncommunicated address will be processed.
The Customer acknowledges that:
- rules may differ by delivery country;
- voluntary Swiss returns follow a commercial policy;
- consumers delivered in the EU may benefit from specific mandatory rights.
13. Defects, non-conformity and warranties
The Customer must check the product on receipt and promptly report any apparent anomaly, error or damage.
Where a product has a defect or non-conformity under applicable law, Resell Lausanne handles the request in line with the Customer’s mandatory rights.
Where a manufacturer commercial warranty appears relevant, Resell Lausanne may refer the Customer to the brand or competent after-sales service, or assist, without excluding mandatory legal rights.
The following are not defects attributable to Resell Lausanne: normal wear, use-related alteration, humidity, improper care, unsuitable washing, accidental damage, post-delivery modifications, use contrary to brand recommendations.
14. Intellectual property
The Site, its architecture, catalogue, texts, visuals, photographs, graphic elements, logos, databases, product selections and content remain protected by applicable intellectual property rights.
Any unauthorised reproduction, representation, extraction, reuse, distribution or exploitation is prohibited.
15. Personal data
Customer personal data is processed in accordance with our privacy policy.
16. Limitation of liability
To the extent permitted by law, Resell Lausanne is not liable for indirect damages, loss of business, loss of opportunity, loss of profits or immaterial harm arising from use of the Site or performance of an order.
No clause excludes or limits liability where such exclusion or limitation is prohibited by mandatory law, including in case of gross negligence or wilful misconduct.
17. Force majeure
Resell Lausanne shall not be liable for delay or non-performance due to force majeure or any event reasonably beyond its control, including strike, logistics blockage, supplier failure, pandemic, natural disaster, administrative decision, cyberattack, customs blockage, war, civil unrest or widespread outage.
18. Governing law and jurisdiction
These T&Cs are governed by Swiss law.
If the Customer acts as a consumer and benefits from more protective mandatory rules of their habitual residence, those rules remain reserved.
Subject to mandatory consumer venues, any dispute falls under the exclusive jurisdiction of the courts of the Canton of Vaud, Switzerland.
